1. This Notice may be cited as the Declaration of Areas to be Aerodrome Control Areas Notice.
2. Each of the following areas is declared to be an aerodrome control area for the purposes of the Aerodrome (Licensing and Control) Act, such areas of land being in the vicinity of the land declared to be an aerodrome by the Declaration of Aerodromes Notice–
(a) all that area of land in the Kisarawe District shown edged in red on Registered Plan No. A.V. 85A, deposited in the office of the Commissioner for Surveys;
(b) all that area of land in the Tanga District shown edged in red on Registered Plan No. A.V. 87A deposited in the office of the Commissioner for Surveys.
THE AERODROMES (APPOINTMENT OF DIRECTOR OF AERODROMES) NOTICE
(Section 19)
[1st July, 1982]
1. This Notice may be cited as the Aerodromes (Appointment of Director of Aerodromes) Notice.
2. The public officer for the time being in charge of the Aerodromes Division in the Ministry for Works is hereby appointed to be the Director of Aerodromes for the purposes of this Act.

THE AERODROMES (LICENSING AND CONTROL) (EXEMPTION) ORDER
(Section 11(2))

1. This Order may be cited as the Aerodromes (Licensing and Control) (Exemption) Order, 2001.
2. Any Mission Aviation Fellowship aircraft is hereby, for purposes of providing medical services to the needy exempted from landing or taking off on land or water which is a licensed aerodrome.
REGULATIONS
THE AERODROMES CONTROL REGULATIONS

1. Citation and application
These Regulations may be cited as the Aerodromes Control Regulations, and shall apply to the aerodromes specified in the Schedule.
2. Interpretation
In these Regulations, unless the context requires otherwise–
“aerodromes” means any Government controlled aerodrome which is specified in the schedule to these Regulations;
“Airport Manager” means the officer responsible for the administration and operation of any aerodrome;
“Director” shall have the meaning assigned to it in the Aerodrome (Licensing and Control) Act function a2(msg) { myWindow=window.open(”,”,’width=163,height=72,left=400 ,scrollbars=1,top=400,screenX=400,screenY=100′);myWindow.document.write(msg);}*.
3. Protection of aircraft and equipment
(1) No unauthorised person shall, within the airport–
(a) tamper or interfere with any aircraft or any vehicle, machinery, equipment or other apparatus used in connection with any aircraft;
(b) smoke or otherwise bring any naked light or otherwise do any act which is likely to cause fire within fifty feet of the movement area of any aircraft or of any store of fuel or explosives;
(c) have any oiled waste, waste oil, cleaning rags or articles liable to spontaneous combustion or otherwise inflammable on, or near an aircraft on the ground, or near any fuelling unit, hangar, workshop, building or installation in which any combustible liquid is stored;
(d) store any combustible liquid in a quantity exceeding twenty litres except in such places of the airport, and subject to such conditions as may be specified by the Director or the Airport Manager in writing.
(2) A person who may be allowed to store any combustible liquid not otherwise prohibited under paragraph (d) of subregulation (1) of this regulation shall keep such combustible liquid in a closed metal container in a cupboard and under lock and key.
(3) The restrictions by paragraph (d) of subregulation (1) and subregulation (2) of this regulation shall not apply to any petrol which may be contained in the tanks of any aircraft, motor vehicle or approved fixed unit.
4. Occupier of premises
Every owner, tenant or occupier of any premises within any airport compound shall–
(a) provide and maintain in good working order, on the premises, fire-fighting appliances and equipment and to a standard approved by the Director or the Airport Manager;
(b) have, in the case of emergency, persons competent to operate the fire-fighting appliances and equipment.
5. Entry to the Airport
(1) No person shall enter or leave the airport except by the entrances and exits specifically provided for the purpose otherwise than with the permission of the Airport Manager.
(2) No person shall enter or be in any part of the Airport other than that reserved for the use of members of the public, except with the permission of the Airport Manager.
(3) No person shall enter any restricted area except with the permission of the Director or Airport Manager.
(4) No person shall remain in the airport after having been required by the Airport Manager or a member of his staff or a Police Officer to leave it.
6. Control of vehicles
(1) No person shall bring a vehicle into any part of the airport which is not set aside for the passage of vehicles except with permission of the Airport Manager.
(2) No person shall park a motor vehicle or permit it to remain parked otherwise than in any area designated as a parking area.
(3) Any vehicle parked in contravention of subregulation (2) of this Regulation shall be removed by the person in charge of the vehicle, without undue delay, upon the order of the Airport Manager or Airport Police Officer. Where the person in charge of the vehicle cannot be traced the Airport Manager or Airport Police Officer shall have the vehicle removed at the owner’s risk and cost.
(4) A person who is in charge of a motor vehicle shall, when operating a vehicle within the premises of an airport, observe, in addition to any traffic regulations in force, any regulations which may be imposed by the Airport Manager.
7. Report of accidents
A person who is involved in any motor vehicle accident within the premises of the airport shall report the accident to the Airport Manager or any person acting on his behalf.
8. Control of animals
(1) No person shall bring any animal or permit any animal to enter upon the airport except on a lead or otherwise under proper control.
(2) Any person in charge of an animal shall remove it from the airport when required to do so by the Airport Manager or any duly authorised member of his staff or Airport Police Officer.
(3) Any animals or bird found on the airport, which is not under the control of any person, shall be destroyed upon the order of the Airport Manager where he considers it necessary for the safety of aircraft or the public using the airport.
9. Radio operation
No person shall operate in the airport any radio or transmitting device which is likely to interfere with the aircraft or ground communication service.
10. Control of Firearms
(1) No person shall carry firearms, explosives or inflammable materials within the airport premises without a written permission of the Airport Manager.
(2) A person who is not authorised under subregulation (1) of this regulation to carry any firearm, explosives or inflammable material shall surrender the same to the Airport Police Station.
(3) Any firearm, explosive or inflammable materials carried unlawfully by any person within the airport premises shall be seized by Airport Police.
11. Restriction on installation of engines and electrical apparatus
(1) No person shall install or cause on to be installed for use in any building within the premises of the Airport, any engine or electrical apparatus of any kind or make or cause to be made any alteration or addition to existing electrical installation in any building without the consent of the Director or the Airport Manager, in writing.
(2) All places where facilities for the charging of batteries are to be installed, shall first be inspected and approved by the Director or the Airport Manager. No such installation shall be left unattended unless the power supply has first been switched off or the battery leads have been disconnected.
12. Regulations on aircraft
(1) No person shall park any aircraft in any area within the airport compound other than that prescribed by the Aircraft Manager or, the Officer on duty designated as the Aircraft Marshaller or, where he is not available, the Air Traffic Control Officer.
(2) No person shall move any aircraft or cause it to be moved on the parking area or loading platform without first obtaining the permission of the Officer designated as Duty Aircraft Marshaller or, where he is not available, the Duty Air Traffic Control Officer.
(3) No person shall interfere or tamper with any aircraft or put its engine in motion without the permission of the owner or his duty authorised agent.
(4) No person shall start or run any engine in an aircraft unless a person competent in running engines, a pilot properly certified to fly the type of aircraft involved on an engineer holding a permit or licence to run and test engines is in the aircraft attending to the engines control. Chocks or blocks equipped with ropes or other suitable means of pulling them shall be placed in front of the wheels before starting the engine.
(5) No person shall repair an aircraft, an aircraft engine, propeller or any other of its appliances in any area of the airport other than that specifically designated for that purpose, or repair or run an engine for test purposes on the loading platform (Terminal apron) unless it is absolutely necessary and with the permission of the Airport Manager, the Duty Aircraft or Marshaller or the Air Traffic Controller.

(6)(a) No person shall fuel or defuel any aircraft within fifteen metres of any building.
(b) Any fuelling operations shall be carried out under the supervision of a qualified engineer or a member of the flight crew of the aircraft, or by a fully trained supervisor appointed by a recognised fuelling company for the purpose.
(c) A fuelling company shall provide efficient appliances and personnel for extinguishing fires during fuelling operations.
(d) A person who is about to fuel an aircraft shall switch off all the radio equipment installed in the aircraft and during the fuelling operation he shall not switch on or off any electrical switch.
(e) No person shall use a fuelling unit or any apparatus for fuelling an aircraft unless the same has been approved by the Airport Manager.
13. General restrictions at an airport
(1) No person shall–
(a) carry on a trade or business;
(b) operate for hire any taxi-cab or omnibus or other vehicle carrying passengers,
within the premises of an airport, without the permission of the Director or the Airport Manager.
(2) No person shall affix to any object anywhere in the airport, or distribute or display within the airport premises any pointed or written matter, signs, advertisement or circular except with the permission of the Director or the Airport Manager.
(3) No person shall take any photograph or make any cinematograph film within the airport except with the permission of the Director or the Airport Manager and subject to any conditions that the Director or Airport Manager may impose.
(4) No person shall commit any nuisance or any disorderly act within the airport.
(5) No person shall–
(a) dispose of garbage, paper, refuse or any other object within the premises of the airport except in the receptacles provided for the purpose of disposal;
(b) trespass on lawns planted areas in the airport.
(6) No person shall–
(a) destroy, injure, deface, or disturb in any way, any building, sign, equipment, mark or other structure, tree, flower, lawn or other public property in the airport;
(b) trespass on lawns or planted areas in the airport; or
(c) abandon any property or other things in the airport.
14. Tenant or lessee to maintain boards
The tenant or lessee of any premises within an airport, if directed by the Director or the Airport Manager, shall maintain boards for the display, of bulletins and notices in a conspicuous place, and shall display on the boards such bulletins and notices as the Director or the Airport Manager may require.
15. Tenant or lessee to stock material properly
No tenant or lessee of any hangars or premises used as workshops within the premises of the airport shall store or stock material or equipment in any manner which may constitute a danger to persons or property.
16. Erection of obstruction prohibited
(1) No person shall erect any obstruction in the vicinity of a Very High Frequency Omnidirectional Radio Range (VOR) Station controlled by the Directorate of Civil Aviation, in contravention of any restrictions imposed.
(2) Any person erecting an obstruction in contravention of subregulation (1) of this Regulation shall remove the obstruction at his own risk and costs upon being required to do so by the Director or the Airport Manager and, in addition, such a person shall be liable to a penalty imposed under these Regulations.
17. Power of entry
The Director or the Airport Manager or any person authorised in that behalf shall have power to enter, at any reasonable time, any premises of the airport for the purpose of inspecting and ensuring compliance with these Regulations.
18. Penalty
Any person who contravenes any of the provisions of these Regulations commits an offence, and upon on conviction is liable to a fine not exceeding twenty thousand shillings or to imprisonment for a term not exceeding three years or to both the fine and imprisonment.

THE AERODROMES LICENSING REGULATIONS

1. Citation
These regulations may be cited as the Aerodromes Licensing Regulations.
2. Interpretation
In these Regulations, unless the context requires otherwise–

“aerodrome licence” means a licence issued by the Director of Aerodromes in respect of an aerodrome.
3. Forms of application for a licence
Every application for the first grant or renewal of an aerodrome licence shall be in Form DA I prescribed in the Schedule to these Regulations or on any other form which the Director may prescribe or approve for that purpose.
4. Procedure on application for first grant of licence
(1) On receipt of an application for the first grant of an aerodrome licence the Director may refer it to the District Council within whose area of jurisdiction the aerodrome is situate, for the purpose of obtaining the views of the Council on the application.
(2) Whenever the Director refers an application to a District Council under this regulation he shall forward the application together with any particulars and information which in his opinion will assist the Council in its deliberations and the expression of its views on the application.
(3) Nothing in this regulation shall be construed as precluding the Director from determining an application for an aerodrome licence without first obtaining the views of a District Council.
5. Form of aerodrome licence
An aerodrome licence shall be in Form DA 2 prescribed in the Schedule to these Regulations.
6. Register of licensed aerodromes
The Director shall keep and maintain a register in the form he prescribes in which he shall enter all material particulars relating to all licensed aerodromes.
7. Power of Director to inspect aerodromes
For the purpose of ensuring compliance with the provisions of the Act or of any other written law the Director or any person authorised by him in that behalf may at any reasonable time inspect any licensed aerodrome or an existing aerodrome in respect of which an application for an aerodrome licence has been lodged with the Director.
8. Conditions of aerodrome licence
The following terms and conditions shall be deemed to be annexed to all aerodrome licences–
(a) the licensee shall observe and comply with all conditions set out in the aerodrome licence in Form DA 2 prescribed in the Schedule to these Regulations;
(b) the licensee shall comply with any technical requirements which may be prescribed by regulations made under the Act relating to the construction of the aerodrome, installation of equipment and associated facilities and their maintenance;
(c) no material alterations to any licensed aerodrome shall be undertaken without the written prior approval of the Director;
(d) whenever a licensed aerodrome becomes unserviceable the licensee shall forthwith notify the fact to the Director-General of Civil Aviation or his nearest representative;
(e) the licensee shall keep and maintain a register, in the form prescribed or approved by the Director in which he shall enter all material particulars relating to all aircraft using his aerodrome and shall make the register available for inspection if required by the Director or any person authorised for the purpose;
(f) the licensee shall submit to the Director, in the form and at intervals specified by the Director, periodic returns relating to the use of the licensed aerodrome for the landing or taking-off of aircraft.
9. Appeals
(1) Any person who, by virtue of the provisions of section 8 of the Act is entitled to appeal against any order or decision of the Director, may within thirty days of that order or decision, appeal against the order or decision by submitting one copy of his memorandum of appeal to the Minister and another copy to the Director.
(2) The memorandum of appeal shall set forth concisely the grounds of the appellant’s objection to the order or decision and shall be signed by the appellant or his representative.
10. Minister may call for additional evidence
On receiving a memorandum of appeal submitted to him in accordance with regulation 9 the Minister shall pursue the same and may either consider and determine the appeal, or may call for such further information from both the appellant and the Director or from either of them which he may consider necessary for the proper and just determination of the appeal.
11. Decision
The decision given by the Minister in an appeal shall be in writing and shall be communicated to both the appellant and the Director.
12. Extension of time
The Minister may on application of an appellant or on his own motion, and upon the terms he thinks just, extend the period prescribed by regulation 9 for the submission of a memorandum of appeal; and that extension of time may be made notwithstanding that an application for extension of time is not made until after the expiration of the prescribed period.
13. Fees
The fees prescribed in Form DA I of the Schedule to these Regulations shall be payable in respect of the various matters mentioned in the said Form.

TERMS AND CONDITIONS ATTACHED TO THE LICENCE
|
1. The licensee shall at all times during the currency of this licence maintain the landing areas, manoeuvering areas, parking areas boundary markings, wind indicators and flying approaches in a condition for safe use by aircraft to the satisfaction of the Director-General of Civil Aviation. In the event of the aerodrome becoming partly or wholly unsafe for use by aircraft he shall forthwith cause to be displayed the ground signs denoting unserviceability and shall notify full particulars by the most rapid means available to the Director-General of Civil Aviation, his nearest representative and to the Director of Aerodromes. |

2. The licensee shall permit the aerodrome to be available for public use/for use only by the following persons or category of persons ……………………………………… and by aircraft of all classes or description/only aircraft of the following class or description ………………………. |

3. The licensee shall, at all times ensure that the aerodrome is open to use by aircraft, provide and maintain to the satisfaction of the Director-General of Civil Aviation, not less than the minimum fire fighting and crash equipment and trained personnel for its operation. |

4. The licensee shall not use or permit the use of the aerodrome for night flying except with the written consent of the Director of Aerodromes. |
|
5. The licensee shall not at any one time effect physical changes or modification to the aerodrome without first obtaining permission in writing from the Director of Aerodromes. |
