CHAPTER 234
MINISTERS AND MEMBERS OF PARLIAMENT (SALARIES AND ALLOWANCES) ACT\n<\/p>\n

An Act to make provision for the salaries and allowances to be paid to the holders of the offices of Vice-President, Prime Minister, Minister, Minister of State, Deputy Minister and Member of Parliament.<\/b>\n<\/p>\n

<\/a>1.    Short title\n<\/p>\n

    This Act may be cited as the Ministers and Members of Parliament (Salaries and Allowances) Act.\n<\/p>\n

<\/a>2.    Interpretation\n<\/p>\n

    In this Act unless the context requires otherwise–\n<\/p>\n

    “Member of Parliament”<\/b> means a member of the Parliament of the United Republic;\n<\/p>\n

    “Office of Minister”<\/b> includes the offices of Vice-President, Prime Minister, Minister, Minister of State and Deputy Minister.\n<\/p>\n

<\/a>3.    Salaries of Minister and Member of Parliament<\/a>\n<\/p>\n

    (1) There shall be paid in any year to the holder of the office of Minister and of Member of Parliament such a salary based on the salary scales applicable to the public service of the United Republic and at such levels as the President may by order published in the Gazette,<\/i> determine.\n<\/p>\n

    (2) The President may determine different levels of salaries for the holders of the different offices in accordance with the weight of responsibility which in his opinion, attaches to those offices.\n<\/p>\n

<\/a>4.    Holder may opt for a higher salary\n<\/p>\n

    Notwithstanding the provisions of section 3 of this Act, any holder of an office entitled to be paid a salary prescribed under this Act who, by operation of any other law or by virtue of holding any other office or for any other reason, would have been entitled to receive a salary higher than that prescribed under this Act, may opt to receive that higher salary.\n<\/p>\n

<\/a>5.    Allowances of Minister\n<\/p>\n

    (1) There shall be paid to the holder of the office of Minister, such allowances as the President may by writing under his hand, prescribe.\n<\/p>\n

    (2) The President may determine different allowances or different rates of allowances to be paid to the holders of the different offices of Minister in accordance with the weight of responsibility which in his opinion is attached to those offices.\n<\/p>\n

<\/a>6.    Allowances of Members of Parliament\n<\/p>\n

    There shall be paid to a Member of Parliament the following allowances at such rates as the President may in writing determine–\n<\/p>\n

    (a)    in relation to the Speaker, Deputy Speaker and a Chairman of a Standing Committee of Parliament, a responsibility allowance;\n<\/p>\n

    (b)    in relation to a Member of Parliament representing a constituency, a constituency allowance;\n<\/p>\n

    (c)    in relation to a Member of Parliament not representing a constituency, a special allowance;\n<\/p>\n

    (d)    in relation to any Member of Parliament –\n<\/p>\n

        (i)    transport and travelling allowance or, in appropriate cases, mileage allowance to over the cost of fuel for a private car;\n<\/p>\n

        (ii)    a subsistence allowance; and\n<\/p>\n

        (iii)    such other allowances as the President may prescribe.\n<\/p>\n

<\/a>7.    President may review salaries and allowances\n<\/p>\n

    The President may from time to time, if in his opinion the circumstances permit, review any salary or allowance determined under this Act.\n<\/p>\n

<\/a>8.    Charge and payment of salaries and allowances\n<\/p>\n

    Any salary or allowance payable under this Act shall be charged on and paid out of the Consolidated Fund.
