    1.<\/b> These Regulations may be cited as the Citizenship (Forms and Fees) Regulations.\n<\/p>\n

    2.<\/b> (1) The forms set out in the First Schedule shall be used for the purposes for which they are designed with such variations as the circumstances of the case may require.\n<\/p>\n

    (2) Every application made in a form set out in the First Schedule, shall be accompanied by the documents if any specified in that form.\n<\/p>\n

    (3) The fees set out in the Second Schedule shall be paid for the matters respectively specified there.\n<\/p>\n

    (4) The Minister, may, in any case, remit either wholly or in part, the fees payable under these Regulations.\n<\/p>\n

PART I
PRELIMINARY PROVISIONS (regs 1-2)\n<\/p>\n

1.    Citation\n<\/p>\n

    These Regulations may be cited as the Tanzania Citizenship Regulations.\n<\/p>\n

2.    Interpretation\n<\/p>\n

    In these Regulations, unless the context otherwise requires–\n<\/p>\n

PART II
NATURALISATION AS A CITIZEN OF TANZANIA (regs 3-9)\n<\/p>\n

3.    Notice of intention to apply for naturalisation\n<\/p>\n

    Each applicant for naturalisation as a citizen of the United Republic under section 9 of the Act shall publish in two consecutive issues of the Daily Newspapers registered in Tanzania Mainland and Zanzibar a notice of intention to apply for naturalisation in Form F as prescribed in the First Schedule.\n<\/p>\n

    (2) That the Minister may–\n<\/p>\n

    (a)    in writing exempt any person; or\n<\/p>\n

    (b)    by order exempt any class persons, from compliance with the provisions of this regulations.\n<\/p>\n

4.    Application form for naturalisation under section 9 of the Act\n<\/p>\n

    An application for naturalisation as a citizen of the United Republic made under section 9 of the Act shall be in Form A as prescribed in the First Schedule.\n<\/p>\n

5.    Naturalisation of minor\n<\/p>\n

    An application for naturalisation of a minor as a citizen of the United Republic made under section 10(1) of the Act shall be in Form B as prescribed in the First Schedule.\n<\/p>\n

6.    Naturalisation of married women\n<\/p>\n

    An application for naturalisation as a citizen of the United Republic by a woman married to a citizen of the United Republic under section 11 of the Act shall be in Form C as prescribed in the First Schedule.\n<\/p>\n

7.    Reversion to citizenship of United Republic by women married to foreigners\n<\/p>\n

    (1) For the purposes of reversion to citizenship of the United Republic by a woman married to a foreigner as provided for under subsection (3) of section 13 of the Act, such a woman shall make a formal application to the Minister indicating her intention of reversion accompanied by evidence that the marriage has irreparably broken down.\n<\/p>\n

    (2) The Minister shall give his consent in writing and upon such consent such woman shall revert to her Tanzania citizenship by birth and her declaration of renunciation of Tanzania citizenship made when she got married to a citizen of another country shall be cancelled.\n<\/p>\n

    (3) The Director of Immigration services shall maintain a register of women who have reverted to Tanzania citizenship by birth.\n<\/p>\n

8.    Procedure for application for naturalisation under section 9 of the Act\n<\/p>\n

    Application forms for naturalisation as a citizen of the United Republic under section 9 of the Act, shall forwarded to the Office of the District Immigration Officer with the recommendation from the ward executive Secretary where the applicant resides and in case of Zanzibar the application shall be accompanied by recommendation from the Sheha.\n<\/p>\n

9.    Form of certificate of naturalisation\n<\/p>\n

    A certificate of naturalisation issued under the Act shall be in form D as set out in the First Schedule and shall be signed by the Director of Immigration Services.\n<\/p>\n

PART III
RENUNCIATION AND DEPRIVATION OF CITIZENSHIP OF THE UNITED REPUBLIC (regs 10-13)\n<\/p>\n

10.    Renunciation of citizenship of United Republic\n<\/p>\n

    (1) A declaration of renunciation of citizenship of the United Republic made under section 13 of the Act shall be in Form E as prescribed in the First Schedule.\n<\/p>\n

    (2) The declaration made under this regulation shall be registered by the Director of Immigration Services.\n<\/p>\n

11.    Deprivation of citizenship of United Republic\n<\/p>\n

    (1) When it is proposed to make an order under section 15 of the Act depriving a person of his Citizenship of the United Republic the notice required by subsection (4) of section 15 and subsection (2) of section 16 of the Act to may be given to that person–\n<\/p>\n

    (a)    where that person’s whereabouts are known, by causing the notice to be sent to him by registered post;\n<\/p>\n

    (b)    in a case where that person’s whereabouts are not known, by sending it to his last known address.\n<\/p>\n

    (2) Where the Minister has given notice under section (1) and the person to whom it is given has the right, on making application therefrom to an inquiry under subsection (5) of section 15 of the Act, the application shall be made–\n<\/p>\n

    (a)    if that person is in the United Republic at the time when the notice is given to him, within twenty-one days from the date of delivery of the notice;\n<\/p>\n

    (b)    in any other case, within such time not being less than twenty-one days from the date of delivery of the notice as the Minister may determine:\n<\/p>\n

    Provided that the Minister may in special circumstances at any time extend the time within which the application may be made.\n<\/p>\n

    (3) Any notice given in accordance with the provisions of this regulation shall, in the case in which the person to whom it is given has the right, on making application before an inquiry under subsection (5) of section 15 of the Act, include a statement of the time within which such application shall be made.\n<\/p>\n

12.    Surrender of certificates of naturalisation\n<\/p>\n

    (1) Where an order has been made depriving a person naturalised in the United Republic of his citizenship of the United Republic, the person so deprived or any other person in possession of the relevant certificate of naturalisation shall, if required by notice in writing given by the Director of Immigration Services, deliver up the said certificate to such person and within such time as may be specified in the notice, and the said certificate shall thereupon be cancelled.\n<\/p>\n

    The Director of Immigration Services shall maintain a register of persons who have been deprived of their citizenship of the United Republic.\n<\/p>\n

13.    Registration of intention to remain Tanzanian\n<\/p>\n

    (1) An application for registration of intention under paragraph (d) of subsection (2) of section 15 of the Act may be made by means of a letter addressed to the United Republic consulate or the Minister stating the name and address of the applicant the date and number of the certificate of naturalisation, the date of his departure from the United Republic or, as the case may be the date of his last registration of intention under section 15 of the Act and the applicant’s intention of retaining his citizenship of the United Republic.\n<\/p>\n

    (2) An application for registration of intention under paragraph (d) shall be made so as to reach the United Republic consulate to which it is addressed or the Minister as the case may be not later than the fifth anniversary of the date of the applicant’s departure from the United Republic and thereafter not later than the fifth anniversary of the date of his last registration of intention under section 15 of the Act.\n<\/p>\n

    (3) Every such application received by Tanzania consulate or the Minister shall be registered at that consulate or the Immigration department as the case may be.\n<\/p>\n

PART IV
SUPPLEMENTAL PROVISIONS (regs 14-16)\n<\/p>\n

14.    Evidence in support of certain applications\n<\/p>\n

    An application for naturalisation as a citizen of the United Republic shall be supported by the evidence specified in the appropriate form or such other evidence as the Minister may require.\n<\/p>\n

15.    Sponsorship of certain application\n<\/p>\n

    Every application for naturalisation as a citizen of the United Republic made in accordance with sections 9, 10 and 11 of the Act, shall not be accepted unless it is signed in the presence of or administered by a magistrate or a Commissioner for Oaths.\n<\/p>\n

16.    Fees\n<\/p>\n

    (1) Subject to the provisions of this regulation the fees specified in the second schedule shall be payable to the Director of Immigration services.\n<\/p>\n

    (2) One quarter of the fee payable in respect of the grant of a certificate of naturalisation, shall be payable on the submission of the application for a certificate and shall in no circumstances be returned, and the balance shall be payable in respect of the grant of a certificate to the other.\n<\/p>\n

    (3) The Minister may in respect of any person or class of person, waive or reduce any fee payable under these regulations.\n<\/p>\n
